The Privacy Policy describes how Equinox Media LLC (“Equinox Media”) and its subsidiaries operating under the Equinox brand (collectively, “Equinox Media” “we” and “us”) process personal information about you.
This Privacy Policy applies to personal information we collect:
When you visit or use websites operated by us (including http://www.equinox.com, http://www.equinoxexplore.com, and http://www.equinoxtheshop.com) or software applications (including mobile apps, automated tools, and chat functionalities) made available by us for use on or through computers and mobile devices and any other online services or platforms we provide (collectively, our “Sites”);
When you visit and use our EQUINOX-branded locations (our “Clubs”);
When you make a reservation, visit or stay as a guest at one of our properties
Contact our customer service team, engage with us on social media platforms that we control, communicate with us, apply to work for us, purchase our products or services, or otherwise interact with us.

Personal Information We Collect
The type of information that we collect depends on your interaction and relationship with us, and which personal information you choose to provide to us. In the 12 months preceding the last updated date above, we have collected the below categories and types of personal information.
Identifiers. We may collect name, postal address, telephone number, email address, business contact information, online identifiers (Facebook ID, Google ID, LinkedIn ID, Twitter ID, etc.), account username or email address, account password, and account security questions and answers, social security number, driver’s license number, passport number, tax identification number, and signature.
Financial Information. We use a third party payment processors to collect credit or debit card number, expiration date, CVV number, and any other information necessary for processing your payment information, such as your billing address. If you pay with a credit card or other form of electronic or online payment, the payment information that you provide is transmitted directly to our payment processors who will process and store your personal information.
Audio/Visual Data. We may collect audio, electronic, photographic, visual or similar data including security camera recordings, audio recordings (such as when you call customer service), photographs, audio messages, and text messages. In some cases we may give you the ability to provide a photograph or other likeness or image to us.
Commercial Information. We may collect records of the products or services you purchased, obtained, or considered. We also collect your purchasing history.
Education Information. We may collect your education history, degrees, certifications, and qualifications.
Device, Internet or Electronic Usage Data. We may collect data related to your device and network and website interaction history, including device type, browser type, operating system, IP address, information collected by cookies or pixels, interaction with advertisements and browsing time, and browsing/search actions and history.
Geolocation Data. We may collect geolocation data including the general region or area from which you access our Sites and your precise geolocation when you request that we show you which of our locations are closest to you or otherwise select a club.
Characteristics of Protected Classes/Demographics. We may collect your date of birth, age, gender, nationality, racial or ethnic origin, religion, sexual orientation, marital status, citizenship status, military or veteran status, and disability information.
Biometric Information. We may collect your biometrics such as your sleep patterns, body scans, facial geometry, facial scans, and other forms of facial recognition
Health and Wellness Information: We may collect health and wellness information including your medical history, health conditions, labs and lab results, biomarker information, treatments, diagnoses, prescriptions, supplements, medical records, fitness assessments, metabolic conditions, information shared with your personal trainer or nutritionist; fitness and exercise activity data (such as heart rate, watts or power, RPM or cadence, and similar metrics), menstruation cycle and pregnancy status, diagnostic results or other test results, and measurements such as height, heart rate, and weight.
Professional and Employment Information. We may collect job application details such as your employment history, resume, references, certifications, licenses, and pre-employment screening and background check information, including criminal records information.
Inferences. We may use information from the categories of personal information described above in order to create inferences about you and we may also receive inferences about you from third parties.
Sources of Personal Information
In the 12 months preceding the last updated date above, we have collected personal information in the following ways:
From You. We may collect information that you provide directly to us.
Through Cookies and Similar Technologies. When you access our Sites, or we send you emails, we may collect information about you, as well as information concerning your browser or device, using tools like browser cookies and pixels.
From Service Providers. We may receive personal information from third parties that support the operation of our business, products, services, and Sites. This includes, for example, cloud hosting providers, lawyers, bankers, tax consultants, auditors, insurers, payment processors, financial institutions, email delivery vendors, background and criminal history check providers, internet service providers, marketing companies, operating systems and platforms, order fulfillment companies, security companies, and customer support services. We refer to these third parties as “Service Providers” in this Privacy Policy.
From Strategic Partners. We may receive information about you from companies that we partner with that provide other services or products to you. We refer to these third parties as “Strategic Partners.” By way of example (and not exhaustive), if you choose to link your accounts with Bilt, Flex, or with Oura, Garmin, Fitbit, Apple Health, or similar wearables or apps to your Equinox account to your account with us, we may receive information about you from these Strategic Partners.
On-Site Business Partners. For your convenience, Equinox Media may offer products or services provided by third party operators, including clothing, accessories, body and skincare products, fitness equipment, health and fitness analysis, spa services, sleep analysis, biomarker reviews, and fitness training. Third party operators operate independently from us, and the privacy practices of the relevant third parties, including details on the information they may collect about you, are subject to the privacy policies of those third parties, which we strongly encourage you to review, as their practices may differ from ours. If you choose to provide information or purchase products or services from them, we may receive information about you and your purchases and interactions.
Through Social Networks. Depending on the information you choose to share and the way you have set your privacy settings on your social media accounts, most social media platforms, like Facebook or TikTok, analyze data about how you interact with our Sites and combine it with information they have about you. They may provide this information about you as well as inferences derived from this information to us and other third parties. In addition, we may receive information about you if your or other users interact with us on social media and information about you is visible to us, for example the fact that you are “friends” or other public-facing profile information.
From Ad, Analytics, and Data Providers. We may receive information about you from third parties that provide us with online advertising, data analytics, or data broker services. This includes when conduct email campaigns, receive information collected through our Sites, and receive information and inferences such as Site trends, usage, and statistics. We refer to these third parties as “Ad and Analytics Providers.”
From Other Individuals. This includes when friends and family refer you to our products, services or offers.
From Your Employer. We may collect information from your current employer if you use them as reference during the application process, we check your employment history during the application process or if you are a representative of a business.
From Affiliates. We may also receive information about you from our corporate parent, subsidiaries, affiliates, or other related companies. We refer to these companies collectively as “Affiliates” in this Privacy Policy.
Use of Personal Information
In the 12 months preceding the last updated date above, we have used personal information for the following business and commercial purposes:
To complete and process your purchases, provide you with the products and services you have requested or purchased, and process your payments to us.
To create training, fitness, and nutrition programs and recommendations.
To communicate with you.
To create, administer, secure and maintain member and loyalty accounts and profiles.
To communicate with Strategic Partners about products and services you have requested or obtained from either us or the Strategic Partners.
For recruiting and hiring.
To analyze preferences, trends and statistics for our Sites, marketing, products, and services, and to improve them.
For marketing and promotional purposes, including to improve our marketing efforts, prospect for new customers, administer sweepstakes, hold contests and events, administer promotions, provide you with special offers or discounts, and to provide you with information about us, including personalized marketing communications.
To create inferences about you, including by combining data we receive from or about you. We combine information across devices and sites as well as both online and offline information. We may also combine information we get from a third party with information we already have.
To provide, maintain, secure, and improve our Sites, products, services, computer networks, and IT systems, including to detect and prevent fraud, theft, and misconduct.
To comply with our legal obligations, contractual obligations, and other compliance obligations, including satisfying our reporting requirements, asserting our legal or contractual rights, and participating in legal proceedings.
To obtain investments or participate in other corporate transactions.

We may also use data that we collect on an aggregated or anonymous basis (meaning that it does not identify any individuals) for various purposes, where permissible under applicable laws and regulations, to help deliver products, services, and content that are better tailored to the users of our Services and for other purposes.
In the 12 months preceding the last updated date below, we have not used or disclosed sensitive personal information for purposes to which the right to limit use and disclosure applies as described in section 7027 (m) of the California Consumer Privacy Act Regulations.
Disclosure of Personal Information
In the 12 months preceding the last updated date above, we have disclosed personal information in the following circumstances:
To Service Providers so that they may provide services to us or our Affiliates.
To Affiliates for reporting and compliance purposes and to allow them to contact you for their own advertising or marketing purposes.
To Social Networks and Ad, Analytics, and Data Providers so that they may provide services to us. They may also disclose your information to other third parties and use your information for their own business and commercial purposes such as for marketing or advertising or to create datasets, analyses and inferences.
To Strategic Partners to fulfil our contractual obligations and allow them to contact you for their own advertising or marketing purposes. In addition, if you enroll in or purchase a product or service from us and the Strategic Partner will provide part of the product or service or provide you with discounts or credits, we will disclose your information to them.
To On-Site Business Partners to fulfil our contractual obligations and allow them to contact you for their own advertising or marketing purposes. In addition, if you enroll in or purchase a product or service from us and the Business Partner will provide part of the product or service or provide you with discounts or credits, we will disclose your information to them.
To Government Entities, including government, administrative, law enforcement and regulatory agencies; tax authorities; and other public agencies or authorities if we think we should in order to comply with any applicable law, regulation, legal process or other legal obligation. This includes cooperating with law enforcement when we think it is appropriate, obtaining legal remedies or limiting our damages, and to enforcing or protecting our contracts, legal rights or the rights of others, including by responding to claims asserted against us.
To Corporate Transaction Participants,including potential investors, purchasers, merger partners, and their service providers and advisors in the event we: (i) sell or transfer, or are considering selling or transferring, all or a portion of our business or assets; or (ii) are considering or engaging in any reorganization, conversion, merger, sale, joint venture, assignment, transfer or disposition of all or any portion of our ownership interest, business or operations; or (iii) are soliciting or accepting investments.
For Other Reasons we may describe to you, including if you consent to the disclosure or direct us to disclose your information.
We do not sell personal information in exchange for money. However, we do use cookies and other online tracking technologies which may be a “sale” of personal information or a “sharing” of personal information for targeted or cross-context behavioral advertising, as such terms are broadly defined under state privacy laws. In the 12 months preceding the last updated date above, we have “sold” to or “shared” with Ad, Analytics, and Data Providers the following categories of personal information: identifiers, commercial information (including purchase history or usage), geolocation data, internet or electronic usage data, and inferences. We do not knowingly sell or share the personal information of minors under the age of 16.
Retention of Personal Information
We will retain and use your information for as long as we need it to provide you products or services, or as long as necessary to comply with our legal obligations, contractual obligations, and other compliance obligations, resolve disputes, and enforce our agreements. We use the following criteria to determine retention periods:
how long the information is needed to provide our products and services and operate our business;
whether there are contractual or legal obligations that exist that require us to retain the information for period of time;
whether any law, statute, or regulation allows for a specific retention period;
whether an individual has agreed to a longer retention period;
whether the data is considered to be sensitive data; and
what the expectation for retention was at the time the data was provided to us.
Your Choices Regarding Geolocation
When you use our Sites, we may request permission to obtain your location to better provide you with location-specific information, including, but not limited to, facility hours, class schedules and teacher updates, or in-club promotions. In that case, the Sites will utilize location services on your browser or mobile device to collect and use location data, including the real-time geographic location. If you consent to our utilization of location services, we may use GPS, Bluetooth, your device’s unique identifier, and/or your IP Address, along with Wi-Fi and cell tower locations, and other technologies to determine your device’s geolocation. We will collect geolocation data only if you consent, and you may choose in your browser and app settings whether the location services will be always running or only when the Sites are in use. You may also choose to disable location services through our app in the “Settings” function of your mobile device or browser, but if you do so, you will not receive any notifications or services that require a geolocation. You can also contact your mobile service carrier, browser provider, or your device manufacturer for more information on disabling location services.
Use of Cookies, Pixels, Analytics, and Similar Technology
Cookies and Similar Technology. When you access our Sites, we (and third-party companies we work with) may collect and store certain information by using technologies such as server logs, cookies, web beacons, clear gifs, tags, e-tags, flash cookies, log files, pixels, code, JavaScript packages, mobile advertising IDs (such as Facebook cookies or Google's Advertising ID), cross-device linking, and similar technologies. The information collected includes information about your activities on our Sites, IP address, browser or operating system type and version, device IDs, and demographic or inferred-interest information, as well as information or communications you have submitted to us through the Sites. We use this information to understand general usage and volume statistics, how users navigate to and around our Sites, what content is viewed or accessed, and which products and services have been obtained. We also use these technologies to keep track of your preferences and profile information. We also use these technologies to allow third-parties to provide analytics and advertising services and serve advertisements on our behalf across the Internet and in mobile applications. For example, our advertising partners may use the fact that you visited our Sites to target advertising to you on other websites and mobile apps on your current device or on other devices you use. They may match your browsers or devices if you log into the same online service on multiple devices. These third parties partners may use this information for our and their own advertising, analytics, attribution, and reporting purposes.
Opting Out of the Sharing of Information For Targeted or Behavioral Advertising. To learn more about interest-based advertising, tracking technologies, and how to opt out, please visit http://www.aboutads.info/choices. You can opt out of the sharing of your personal information for cross-contextual behavioral advertising or targeted advertising through online tracking technology by clicking on the Cookie Settings link in the footer of your screen on the Sites or in the mobile application by clicking on your profile, clocking on “Do not sell or share my personal info link at the bottom” and then clicking on cookie settings under “For Automated Technologies” and disabling cookies for targeting or cross-context behavioral advertising.
Browsing or Chat Session Information. We use technologies that maintain records of your browsing session, chats, and other activities on our Site. These technologies may include session replay that maintains a record of your interactions with our Site; chat providers that maintain a transcript of your chats; cookies, pixels, and other tracking technologies that share some of your interactions with our Site; and other technologies that collect and share your interactions with our Site. We use this information for quality control, customer service, fraud prevention and security, and marketing purposes.
Global Privacy Control and Opt-Out Preference Signals. Some browsers or browser extensions also allow you to tell websites not to share your information for cross-contextual behavioral advertising through the “Global Privacy Control” or other opt-out preference signals. If you have enabled Global Privacy Control or an opt-out preference signal on your browser or extension, we will honor such requests that can be recognized by our Sites by disabling targeting and cross-context behavioral advertising cookies in a frictionless manner. Please note that we may not be readily able to associate an opt-out preference signal with other personal information such as your email address. You will also only be opted out of online sales or sharing of personal information, and will need to turn it on for each browser you use.
Do Not Track Signals. Some browsers have a “do not track” feature. It lets you tell websites you visit that you do not want them to track your online activity. These features are not yet uniform across browsers. Our Sites are thus not currently set up to respond to these signals. Google Analytics. We use analytics services provided by Google Analytics. If you would like more information on how Google uses data when you visit or use our Site, please visit www.google.com/policies/privacy/partners. Links to Other Websites
Our Sites may include links to other websites or applications whose privacy practices may differ from ours. If you submit personal information to any of those websites or applications, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit or application that you use.
Security
We use reasonable security measures required by law. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security and encourage you to use our websites and share information with caution.
Our Sites are Not Intended for Children
Our Sites are not directed to children under the age of 13. We do not knowingly collect or store any personal information from anyone under the age of 13. If we become aware that we have collected or stored personal information from an individual under age 13, we will remove his or her personal information from our files. If you are a parent or guardian and believe we may have inadvertently collected personal information from your child, please notify us by emailing privacy@equinox.com
Your Choices Regarding Marketing Communications
Marketing Emails. You can opt out of marketing or advertising emails by using the “unsubscribe” link in the email at any time. Once we process your request, we will cease using the information for such purposes at no charge to you. If you opt out of getting marketing messages, you will continue to receive messages from us about your relationship with us where permitted by law.
Phone Calls. If you choose to provide your telephone number to us, we will opt-you in to receiving telephone calls from Equinox Media, our Affiliates, and our Service Providers, and/or our Strategic Partners, on the telephone phone number(s) you share with us including using automated telephone dialing systems, prerecorded messages, or other automated systems. You agree to receiving these calls even if your telephone number(s) is/are registered on any state or federal Do Not Call list. To opt-out of receiving automated marketing telephone calls, please contact us at +13322147190 or privacy@equinox.com, or reply STOP to any SMS, MMS, Text, and other Digital Messages. Please note that even if you opt out of automated calling, we reserve the right to call you using non-automated means and for non-marketing purposes in accordance with applicable law.
SMS, MMS, Text, and other Digital Messages. You have the choice to opt in to receive messages from us on the mobile phone number(s) you share with us. If you choose to opt-in, Equinox Media, our Affiliates, and our Service Providers, and/or our Strategic Partners, will send you messages in various formats including text messages alerts, over-the-top messages, short message service messages, short code, multimedia messaging service, graphic images, graphic messages, images, and any other mobile transmissions. These messages may include, but are not limited to, sales, marketing, event and certification communications, reminders, insights, product updates, and personalized recommendations.
If you choose to opt-in, you agree that messages may be sent to your telephone number(s) using automated telephone dialing systems, prerecorded messages, or other automated systems, and even if your telephone number(s) is/are registered on any state or federal Do Not Call list. You agree to receive messages from or on behalf of Equinox Media, even if you terminate your business relationship with us, until you opt out. By opting-in you verify that you are the current subscriber or owner of any telephone number you provide and you are strictly prohibited from providing a phone number that is not your own. Should any of your contact information change, including ownership of your telephone number(s), you agree to immediately notify us before the change goes into effect by texting STOP, CANCEL or END to the number from which you receive the message.
You do not have to opt in to use and enjoy our products or services. Message frequency may vary. Messaging and data charges may apply. You may choose to opt out at any time. Please note that even if you opt out of automated messages, we reserve the right to send non-automated and non-marketing messages to you in accordance with applicable law. However, we may share opt-in data (1) with vendors, consultants and other service providers who need access to such information to carry-out work on our behalf; (2) if we believe disclosure is required by law; or (3) otherwise with your consent.
Processing in the United States
Please be aware that information we obtain about you will be processed in the United States by our service providers or us and that the data protection laws and regulations that apply to your personal information transferred to the United States or other jurisdictions may be different from the laws in your country of residence. The United States may not afford the same level of protection as laws in your own country. Transfers of personal information are conducted through mechanisms and with protections that comply with applicable laws (such as data transfer agreements that that contain standard contractual clauses adopted by the U.K. Information Commissioner). In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal information. By using the Sites or any of our products or services, you understand and agree that we may share your personal information among our affiliates, our service providers, and other third parties, which may be located in countries outside of your own.
U.S. Privacy Rights
This section applies to you if you are a resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah or Virginia.
Your Rights. Subject to certain exceptions and limitations, consumers have the following rights:
You have the right to request that we confirm whether we are processing your personal information and to access your personal information by obtaining a copy of your personal information.
You have the right to correct inaccurate personal information that we hold about you, taking into account the nature of the personal information and the purposes of the processing of the information.
You have the right to request that we delete personal information that we have collected from you or obtained about you.
You have the right to opt out of the processing of the personal information for purposes of (i) targeted advertising, (ii) the sale of personal information, or (iii) automated decision-making or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
If you are an Oregon consumer, you have the right to request that we provide you a list of the categories of personal information that we process about you and a list of the categories of third parties to whom we have disclosed your personal information or, at our election, any personal information.
If you are a Maryland consumer, you have the right to request that we provide you a list of the categories of third parties to whom we have disclosed your personal information orany personal information if we do not maintain this information in a format specific to each consumer.
If you are a Delaware consumer, you have the right to request that we provide you with a list of the third parties to whom we have disclosed your personal information or any personal information.
If you are a Minnesota consumer, you have the right to: (1) request that we provide you with a list of the third parties to whom we have disclosed your personal information or any personal information; and (2) question the result of profiling, be informed of the reason that the profiling resulted in the decision, and, if feasible, be informed of what actions you might have taken to secure a different decision and the actions that you might take to secure a different decision in the future, if your personal data was profiles in furtherance of a decision that produces a legal or similarly significant effects.
If you are a California consumer, you have the right to request that we tell you (i) what personal information we have collected about you, (ii) the sources of that information, (iii) the business or commercial purposes for collecting, selling or sharing the personal information; and (iv) the categories of third-parties to whom we have disclosed personal information.
The right to not be discriminated against for exercising your rights above.
Exercising Your Rights. To exercise any of your rights, you may submit a request through our webform (available at https://www.equinox.com/privacyrequest) or call our toll-free number at +13322147190). For all requests, other than requests to opt out of the sale or sharing of your personal information, you must provide us with your name, email address, phone number, and which rights you would like to exercise. We will verify your identity by matching the information we have collected against the information you have provided. Failure to provide the foregoing information may prevent us from processing your request. For requests to opt-out of the sale of personal information or behavioral/targeted advertising, we do not need to verify your identity and you only need to provide your name and email address. If you have requested that we correct your personal information, please also provide any information about the personal information that you believe is inaccurate, including supporting documentation. In order to designate an authorized agent to act on your behalf, you must also send a signed, written authorization to us.
Appealing Our Decision. If we refuse to take action on your request, you may appeal our decision within a reasonable period of time, not to exceed 45 calendar days from the date of your receipt of our response. You may exercise your appeal rights by emailing us at privacy@equinox.com. This right only applies to residents of certain states. Please include your full name, the basis for your appeal, and any additional information or documents that you would like us to consider.
Notice of Financial Incentives and Right To Opt Out. We may provide special offers and benefits, such as a discount offer, as an incentive for individuals who sign up to receive marketing communications from us. In exchange for these incentives, you agree to provide certain personal information for use by Equinox Media for the reasons described in the Privacy Policy. The value of this personal information varies based on the special offer provided at the time you sign up, the amount purchased by you when using that special offer, and value of future special offers you receive from us and use to make purchases. For example, the value of a 15% discount on a purchase from Equinox Shop will differ depending on how much you purchase. The incentives we offer to you are reasonably related to the value provided to us by your personal information. If we offer a financial incentive, you may opt-in to it by following the prompt to enter your email address to receive a discount. You have the right to withdraw from financial incentives at any time by opting out of our marketing emails. See the “Your Choices Regarding Marketing Communications” section of our Privacy Policy to learn how you can opt out of these communications.
California Shine The Light. The California Shine the Light law (Cal. Civ. Code § 1798.83) permits residents of California to request certain details about how their information is shared with third parties for the third parties’ direct marketing purposes. If you are a California resident and would like to make such a request, please contact us at privacy@equinox.com and include "California Shine The Light" in the subject line of your email. You can opt-out of the sharing of your personal information for third parties’ direct marketing by submitting a request to opt out of the sale or sharing of your personal information for targeted advertising or cross-context advertising through our webform (available at https://www.equinox.com/privacyrequest).
United Kingdom Privacy Rights
This section only applies to individuals in the United Kingdom (“UK”).
Your Rights. Subject to certain exceptions and limitations, you have the right to:
Request a copy of the personal information we hold about you.
Correct your personal information if it is inaccurate, outdated, or incomplete.
Request that we delete your personal information.
Restrict the processing of your personal information.
Request that we transfer your personal information to another organization or give it to you (in a structured, commonly used and machine-readable format). This right only applies to personal information that you have provided to us and is held electronically.
Request that we limit processing or stop processing your personal information in certain circumstances including for marketing activities and profiling for marketing activities and profiling for statistical purposes and, subject to certain exceptions, where such processing is based on our legitimate business interests.
Withdraw or revoke consent previously granted to the extent permitted by law.
We will not discriminate against you for exercising your rights, although some of the functionality and features available on our Sites may change or no longer be available to you. In certain cases, these rights may be limited, for example if fulfilling your request would reveal personal information about another person or if you ask us to delete data which we are required by law to keep.

Lawful Basis for Processing Personal Information. The lawful basis for our collection and use of your personal information described in this Privacy Policy is that the processing is (i) necessary for our legitimate interests in carrying out our business, provided those interests are not outweighed by your rights and interests; (ii) necessary to perform a contract with a third-party or with you; (iii) necessary to comply with a legal obligation; or (iv) based, when necessary and appropriate, on your consent.

We try to respond to all legitimate requests within one month. Depending on the scope of your request, or if you require additional copies, we may need to charge you a reasonable fee where permitted under law.
